Motion &c

In the above named case Joseph L Smith counsel for the said Philip Dewees, will at the opening of said court tomorrow, or as soon thereafter as the said motion can be heard, move the said court to rescind the Order substituting William Travors in said case for said Francis P. Fatio, for the reasons that the motion for said order, and the said substitution in compliance with it were both made too late -- and that the said order was unadvisedly given by said court and without adverting to their previous order for the dismissal of said Case agreeably to the 8[th] Rule of the Rules of practice for the Court of Appeals of the Territory of Florida.
