On motion of the defendant by his attorney, It is ordered that the above cause be continued on the said defendants paying all costs which have accrued in said causes to this date, and that the said cause be not again continued on the ground that the commissions issued therein not being returned, and that the said Francis P. Fatio does not destroy or sell the Timber on the land in the declaration of said Philip Dewees and others mentioned.

And afterwards before the Superior Court for the Eastern District of Florida holden at the court house in the city of St. Augustine at the Term of May in the year of our Lord one thousand and eight hundred and Twenty nine to which term this cause had come by regular continuance, to wit, on Tuesday the second day of said Term and the fifth of said month the following entry was made, to wit,

James Jackson on the demise of Philip Dewees,

Louisa Dewees, Mary Dewees, Winslow Foster

and Martha his wife, Catharine Hall,

Margaret Floyd, John Floyd, Dionisio Solano In Ejectment

and Mary his wife and Andrew Floyd plaintiffs

This day came the parties by their attornies and thereupon came a Jury, to wit, Bartola Olivares, John Pellicer, Joseph Delespine, John Geiger, Stephen Aman, Douglass Dummet, Francis Pellicer, Charles W. Clarke, James Pellicer, Joseph Long, Andrew Pacetty, and John Leonardy who were duly sworn well and truly to try the issue joined between the parties, but the court not having sufficient time to go through with the trial. It is ordered that the above named Jury be adjourned over until tomorrow morning at 10 o’clock.
