The Defendants in appeal by [?] Lancaster their attorneys move the Court for an order to compel the appearance of the Legal representatives of the realty of the Estate of Francis P. Fatio decd. late appellant in this cause, and it appearing to the satisfaction of this Court that the said Francis P. Fatio has departed this life since the last term of pendency of this cause in this court. It is therefore ordered by the Court that unless such representatives shall become party, within the first three days of the next Term of this Court, the said Defendants be admitted to have this suit dismissed [mark appearing like period here] provided that a copy of this order shall be printed in some newspaper at Tallahassee, for three successive weeks, beginning at least sixty days before the next Term of the Court.
