and interests of the Defendant in the [?] that the said Complainant as Executor as aforesaid may be required to refund to this Defendant and of the amount paid him for said losses out of the proceeds of said Estate of said Robert McHardy one half of the sum amount for which said Plantation was sold to discharge debts of said Estate should it appear that this Defendant is entitled to only one half or greater amount than one half of said sum should it appear that by law this Defendant is entitled to a greater share than one half of said plantation.
And this Defendant further answering saith that he is one of the Legatees named in the said last will and testament of the said Robert McHardy to whom an surplus after paying the just debts of his Estate was to be paid and distributed in the manner pointed out in the said last will and testament.
And the Defendant further answering saith that in this his answer he has already fully answered the second ninth tenth and eleventh interrogations which in the said Complainants Bill of Complaints this Defendant was required specifically to answer and in answer to the twelfth interrogatory he admits it to be true that the said several Defendants named in said Bill of Complaint have intermarried in the manner and do now reside on the places set forth in said Bill of Complaint.
[?] that [?] of the matter or thing in this said Bill of Complaint contained and not herein and herby will and sufficiently answered confessed avoided traversed or denied is true to his knowledge and belief. All which matters and thins this Defendant is ready to aver prove
