And now on this 14[th] day of January 1847, comes the said Deft Frederick Hoc, Survivor, by [?] as Thompson & Hagman his Attorneys , and suggests and shows to the Court here that there is diminution in the Record filed in this case to wit ( on the 4[th] page of the printed Record ) wherein entry is made of the trial. The jury are said to have been tried & sworn, the truth to speak "upon the issue joined", whereas in the Record of Leon Superior Court it doth appear that they were so tried & sworn the truth to speak upon "the issues "joined"_ And the said Defendant in Error, prays a writ to be [?] to the Circuit Court of Leon County where said Record now remains , directing said Court to certify a more complete record in this case.
