To the Honorable the Judge of the Circuit Court of the middle Circuit of the State of Florida for Leon County Greeting Whereas in a certain cause now rendering in our Supreme Court for the State of Florida wherein John Miller & Bryan Croom and appellants Fredrick Hoc who hath survived Lewis Hoc is appellee the death of said Lewis Hoc having been suggested & the case continued against said Frederick Hoc a diminution of the record is suggested in this. That in the record wherein entry is made of the trial the jury are said to have been tried & sworn the truth to speak upon the issue joined. Whereas in the record of Leon Superior Court now remaining in the possession of Leon Circuit Court it doth appear that they were so tried and sworn the truth to speak "upon the issue joined " you therefore are hereby commanded to certify without distinctly under your seal to the justices of our Supreme Court at the city of Tallahassee the said part of the said record so suggested as a diminution as fully and entirely as the same remains before you so that we may have the same forthwith together with this writ__
