Interposition Resolution in Response to Brown v. Board of Education, 1957

- Description
- The Florida State Legislature passed this resolution in opposition to the 1954 U.S. Supreme Court decision in the Brown v. Board of Education of Topeka, Kansas case that ended legal segregation in public education. Racial segregation was originally found to be constitutional by the U.S. Supreme Court in the landmark Plessy v. Ferguson case in 1896. That decision laid the legal foundation for what became known as Jim Crow laws throughout the nation, and especially in the U.S. South, by declaring segregation legal only if the facilities were "separate but equal." The Brown decision removed that foundation, and many segregationists saw the case as an opening wedge to ending all segregation. Therefore, the Florida Legislature argued that the decision usurped the state constitutional powers, and passed the resolution to declare the Court's decision in 1954 as null and void.

Clarence Simpson, superintendent at Florida Caverns State Park, regarding the increase in African-American attendence at Florida Caverns and the need for segregated bathroom facilities as a result. There is also a handwritten note, dated May 31, 1943, written by Director of State Parks Lewis Scoggin stating that Florida Caverns State Park should arrange for privies for now and plan for permanent facilities for African-Americans at a later date.

- Letter from private citizen James A. Wright to Francis Preston Whitehair calling his attention to the attitudes of several DeLand city council members toward the New York Giants building seasonal housing for both black and white members of their team and staff. Wright expresses his concern that the council members are willing to allow the project to move forward despite its violation of city ordinances prohibiting the mixing of the races in public spaces. Wright attaches several documents to the communication, including a copy of a newspaper article describing how another Giants farm club had handled the issue of segregation, a copy of a statement Wright made to the city commission regarding the Giants' proposed project in DeLand, a copy of the deed for the land where the Giants' project would be located, and the cover page where a city zoning ordinance was to be attached.
