And now on this day came the parties by their Attorneys, and thereupon came the following Jury who were duly elected tried and sworn to try the issue aforesaid, towit, William H. McMillan, H. J. Wyatt, Archd Campbell, Lewis Gray, Thomas D.Wilson, Jesse Williams, John Anderson, Robert Larkins, Wm H. Wilder, William Forbes, Hugh O. McLean, & Hardy Shepard who after hearing the evidence and argument of counsel retired to consult on the verdict. The jury not arguing they were ordered by the court to return their verdict into court tomorrow morning by 10. O'clock

And now on this day the Jury in this case returned into Court their verdict, towit, "We the jury find for Plaintiff and assess the damages at $152.10" so say we all, signed Robert Larkins (foreman). Therefore it is considered by the Court that the said plaintiff do recover of the said defendant the sum of one hundred and fifty two dollars and ten cents, for his damages and also the sum of $ cost, (to be levied of the goods and chattels, lands, and tenements, of said John Oliver, decd, in the hands of said Administrator to be administered), and said defendant in mercy &c,

Whereupon the said defendant prayed an appeal to the next Superior court of Gadsden County
