obtained in the judgment aforesaid together with the sum of twenty five dollars and 89 cents costs the costs aforesaid (and $4[66] common interest in said case, he the said plaintiff then and there , to wit, on the 19[th] day of March 1840 was compelled to pay, as the administrator as aforesaid of the said John Oliver agent as aforesaid for the said Bryan Croom to him the said John Shaw for the use of and on account of the said Bryan Croom, by reason of the payment of which said several sums of money for the use of him the said Bryan Croom so paid by the plaintiff as aforesaid, he the said Bryan Croom then and there became liable to pay the said sum of one hundred and eighty-five dollars and sixty five cents to the plaintiff as aforesaid, and being so liable he the said defendant in consideration thereof then and there undertook and faithfully promised the plaintiff to pay him the said sum of one hundred and eighty five dollars and seventy five cents whenever he the said defendant should be thereunto afterwards requested.

And whereas also the said defendant heretofore to wit on the day and year aforesaid, being indebted to the plaintiff as aforesaid in the further sum of five hundred dollars for money before that time paid, laid out and expended by the plaintiff (as aforesaid) for the defendant & at his special instance and request and in the like sum of money, for money before that time had and received by the defendant to and for the use of the plaintiff (as aforesaid) and being so indebted he the said defendant in consideration thereof undertook and faithfully promised then and there to pay to the plaintiff (as aforesaid) the said sum of five hundred dollars.
